Terms of Service

1. Scope

These Terms of Service apply to the use of PaintableMoments, a service provided by Findoria UG (haftungsbeschränkt), Kolonnenstraße 8, 10827 Berlin, Germany.

2. Service Description

PaintableMoments is an online shop for custom 3D figurine kits you paint yourself. Our service includes:

• AI-powered creation of a 3D model from your photo
• Production and shipping of a figurine kit with paints and accessories
• Step-by-step painting guide

3. Product Specifications

• Figurine height: up to 12 cm per character
• Material (Classic & Cartoon): 3D printed PLA wood composite
• Material (Realistic): 3D printed standard PLA
• Accessories: acrylic paints with up to 16 colours, brush set with up to 4 sizes
• Suitable for ages 5 and up

4. Pricing and Payment

Base price (kit price by number of characters):

• 1 character: 22 €
• 2 characters: 32 €
• Each additional character: +€8 (e.g. 3 characters = €40, 4 characters = €48)

Style upgrades:

• Classic — included (no extra cost)
• Cartoon — included (no extra cost)
• Realistic — +6 € per character

Shipping:

• €3.99 within the EU — free for orders over €40

All prices include VAT. Payment is processed securely via Stripe.

5. AI Usage and Limitations

• The AI creates a 3D model based on your uploaded photo
• The result is an artistic interpretation — not an exact reproduction
• Photo quality affects the quality of the result

6. Prohibited Use

The following is prohibited:

• Uploading photos without the consent of the depicted person
• Automated mass use or scraping
• Sharing login credentials
• Use for unlawful purposes

7. Intellectual Property

The platform, including design, code, and features, is the intellectual property of Findoria UG. The figurine kits you order belong to you upon delivery.

8. Right of Withdrawal

As these are custom-made products created according to your personal specifications, the right of withdrawal is excluded pursuant to § 312g para. 2 no. 1 BGB (German Civil Code). You will be expressly informed of this before completing your order.

9. Limitation of Liability

We are not liable for:

• Differences between the 3D model and the original photo
• The painting result after using the kit
• Temporary service unavailability
• Data loss due to force majeure

10. Termination

You can delete your account at any time. We reserve the right to suspend or delete accounts that violate these Terms.

11. Governing Law

German law applies. The place of jurisdiction is Berlin, where legally permissible.
